Stamina Hydration (together with our affiliates, “Stamina”, “us”, “we”, or “our”) would like to thank you for visiting our website, mobile application (the “App”), content, functionality, and service, including the Appointment Booking Service (the “Booking Service”), (collectively, our “Platform”). The terms and conditions set forth herein and any other document(s) herein (collectively, “Terms”), along with our “Privacy Policy” govern your use of our Platform we make accessible thereby, therefore; please read everything thoroughly before accessing or using our Platform. 

By using our Platform, you (1) acknowledge that you have read, accepted, and agree to be bound by these Terms and Privacy Policy; (2) Represent that you are of legal age to enter a binding contract under the applicable law; (3) you agree that you are legally bound by these terms and our Privacy Policy.

These Terms constitute and electronic contact that represent the legally binding terms of your use of the Platform. You acknowledge that these Terms and Privacy Policy may be modified by us at any time, at our sole discretion with or without prior notice to you, and all modification will be effective upon posting to our Platform. This include but not limited to making modifications, changes, cancel, updates, reconfigure, supplement, remove, limit, terminate, or alter the Platform or any part thereof, including between different users, whether these things done permanently or temporarily. By using our Platform, you also agree we may send you various communication via email, phone call, and text messages. After you have summited a booking, you may receive occasional newsletters, offering, and promotions from us via email. You can unsubscribe from these emails at any time. You will notify us promptly if your email address changes. If you wish not receive email as a form of communication, please notify us at [email protected]. We will not sell or provide your email address to any third party at any time. Your withdrawal of consent will be effective within a reasonable time after the notice have been received. A withdrawal will not affect the enforceability of these Terms and Polices on this Platform. However, a withdrawal of consent to receive communications electronically may result in termination of your use of the Service.

TERMS AND PRIVACY POLICY CONSENT

All provision contained in this Terms and Privacy Policy are effective immediately once our Platform has gone live, this include but not limited to new user but also those users who have established accounts and continues to use our Platform once we go live. The use of any personal information or contribution that you provide to us or collected by us on or through our Platform or its content is governed by all Terms, Conditions and Privacy Policy on our Platform. By using our Platform or its content, you consent to all Terms, Conditions and Privacy Policy, whether you have read it or not.

The personal information that we collect from you consist of information that we deem necessary in order to provide you the most positive experience when you’re utilizing our Platform and its services. We only collect information that is necessary for us to fulfill our obligation in order to arrange optimal healthcare services that will be required by the healthcare professional administering your care. The information we collect, may or will without limitation, your demographic information, certain heath related information, your geographic location, and your payment information (e.g., credit card details).

HOW WE USE COLLECTED INFORMATION

With the information that we collect from you via our Platform, App, Booking Service, Phone intake, text message, or by any other means, will be utilized to optimize all services render to you. This includes but not limited to, communication and outreach, customer service support and returning your message, personalize your health service experience, maintain and improve our Platform quality and functionality, track Platform usage to improve customer support, enhance security, backing up data, and comply with our applicable legal oblations.

WITH WHOM WE DISCLOSE YOUR INFORMATION

We do not share, sell, or otherwise disclose your personal information for the purpose other than those detail in this Terms, Conditions, and Privacy Notice.

We may disclose your personal information to the following third parties for the purpose of quality and service assurance that we provide to you:

  • Due to the nature of our business and our Platform, the medical services that are offer through our Platform will be provide by third-party providers. Third- party medical provers obtain your information in order to provide quality services. We outsource some of Stamina’s functions to third-party providers, such as engaging in a third-party that sets up appointments and sends out appointment reminders to users and providers on our Platform.
  • Please note that when you choose to access certain third-party social media websites and services through our Platform, you are sharing information with those sites, therefore; the information you share will be governed by their website privacy policy.
  • Your personal data will be shared with the following third parties:
    • Our subsidiaries and our affiliates.
    • To contactors and service providers.
    • To public agencies that are required by law.
    • To comply with our legal obligations.
      • Comply with the law, or legal processing, including legitimate and enforceable subpoenas, court order.

  • No matter the case, Stamina will strictly adhere to those applicable laws and regulation governing the use and disclosure of your personal information, especial when comes to protecting your health information.

DISCLOSING PERSONAL INFORMATION

We strongly advise you to not including or providing any personal information in the content you post publicly or any information at can be used to identify or associate to you with your comments. Furthermore, user should comply with the security protocol measure we developed and implemented on our Platform, not limited to his/her username when posting reviews and contents.

CHILDREN ONLINE PRIVACY PROTECTION ACT COMPLIANCE

Stamina’s Platform is not intended for children under 18 years of age and children under the age of 18 is not permitted to use our Platform. We do not knowingly collect Personal Data from children under the age of 18. If we become aware that we have collected or received Personal Data from anyone under the age of 18 without parental consent, we will take necessary measure to remove the information. At Stamina, we are committed to abide by all federal, state, and local laws, governing the integrity and confidentiality of our Personal Data. We have taken measure to implement and administer security designed to protect our user’s information from non-authorized access, us, disclosure, and modification. Although we have taken all the precautionary, no security measures are perfect. If you have concern about your sensitive information (e.g., contract or medical information) being transmitted or disclosed in any matter or form, please consider using non-electronic communication methods. Furthermore, at Stamina we will use reasonable measure to protect the privacy of your information sent by email, SMS or any other similar digital communication. However, we cannot guarantee that all digital communication will be confidential. Stamina will not be liable if you or anyone else inappropriately use your email, access your SMS or any of your digital communication devices. Stamina will not be liable for improper disclosure of user’s information that is not caused by our intentional misconduct.

MEDICAL DISCLAIMER

Stamina Hydration’s Services are designed to allow you to request and book certain COVID Testing and Intravenous Hydration services to be provided by a licensed medical professional. It is very important that you understand that we are not a licensed healthcare provider and are not engaged in the practice of medicine. We only schedule your requested service(s) and bill you on behalf of the licensed medical professional.  We provide various marketing, management, and technological services to one or more licensed healthcare professionals and or providers. If you have any health-related concerns or questions, always seek advice from your physician or other qualified healthcare provider regarding your health condition and or concerns. The use of our Platform is not intended to be use as a substitute for a diagnostic tool, medical advice, and or treatment. We do not recommend that you change any of your medication regiments or any new therapy without consulting a fully qualified physician. Please do not disregard any professional medical advice or delay seeking medical attend based on something you have read on our Platform. We do not recommend or endorse any specific test, treatment, product, procedures, opinions, information that are mentioned anywhere on our platform. Reliance on the content and or information provided on our Platform is solely at your own discretion and risk.

If you think you are experience a medical emergency, place immediately contact your medical provider (e.g., your primary care doctor) or call 911.

All Stamina Hydration Services on our Platform that will be administer by a licensed health care professional are consider as elective treatments for the purpose of wellness and health maintenance only. Therefore, these services, including but not limited to drips, injections, or therapies are not intended to treat or cure any diseases. Furthermore, all services at Stamina Hydration are only available to individuals who are at least 18 years old. If you are not 18 years or older, please do not use our Services.

PAYMENT

Payments: Once you book an appointment with Stamina Hydration, you agree to be bound by these Terms and Conditions on our Platform. You hereby agree to pay Stamina the full payment that is indicated for all scheduled service(s) when booking is made. Payments will be charged at the time of scheduling or at the time of service.

Cancelations: All cancelation must be made at least 24-hour in advance. When booking any service(s) on our Platform, you agree to be bound by these Terms. Failure to notify us in advance of a cancelation will result in a charge of the full payment amount for the service(s) scheduled. If you book your appointment service(s) less than 24-hour in advance, you may not cancel, your cancelation will be non-refundable. Missed appointment are also non-refundable. Group appointments (e.g., part of two or more) follows the same rules as single appointments and will be charged for all people booked unless a 24-hour advance notice of any cancelations. For instant, if you book service for four (4) people, but only two (2) people are present for the service without a 24-hour advance notice for the other two (2) people who did not show or change their mind at time of service, you will be change for all four (4) people services that was booked. Your appointment(s) may be canceled by emailing us at [email protected] or by phone at (727) 300-0247.

Refunds: Refunds are not issue to any missed appointments. Stamina will issue refunds to clients for appointments if the designated medical professional is unable to meet the appointment booking. If the designated medical professional unable to perform the booked services due to the following reasons: (1) your current or previous medical history, condition, or reason; (2) due to circumstances outside of the designated medical professional’s control after the insertion of the I.V. needle; you will receive a credit or refund for the full amount of the services scheduled, less a medical examination fee of one hundred dollars ($100.00). 

Misrepresentations: If in any way during your booking process that you misrepresent yourself in any manner, not limiting to a misrepresentation of your age or medical history, Stamina reserves the right to cancel your booked service without notice and charge you the full amount. This also includes when the designated medical professional shows up to the appointment and notice at his/her own discretion that you may have misrepresented yourself regarding the information you provided on our Platform.

If at the time of service, your designated medical professional his/her own discretion deem that you are under the influence of drugs or alcohol, service will not be render and payment will be charge for the full amount.


Authorization of Charges: Buy using our booking services, you hereby agree Stamina Hydration Terms and Conditions and authorize Stamina Hydration to charge your credit card (or other payment method) for the applicable fees, charges, and taxes.
